's Authority to Implement Health Reforms

Alex Morgan CEO of the company said, “September 2010 is the deadline for the next phase of reforms to be implemented. However, the Virginian government, who has the implement the federal Act, does not even have the authority to do so in certain cases. Some of the key changes that will be implemented by September 23, 2010 are:


-    The age limit of the dependant child is to be extended from 19 years to 26 years


-    No child below the age of 19 would be denied coverage on the basis of pre-existing conditions


-    Insurance companies cannot drop policyholders in Virginia from coverage when they fall sick


-     No co-payments or deductibles to be paid for Level A and Level B preventive care and medical screenings on all new insurance plans.





The National Association of Insurance Commissioners has played down the issue by stating that even though Virginia lacks explicit authority to enforce the health reforms, it can still coax insurers into following the new rules by using related powers such as form approval process, investigative powers and market conduct exam authority.





Virginia is in the company of certain other states such as California, Florida, Hawaii, Michigan, Nebraska, Oklahoma and Wyoming that do not have the authority to enforce the federal act.
